JP Lockhart Limited Liability Partnership (Company Registered in England and Wales, Company Number: OC344285, Registered Office: Dew Farm Barn, Marton cum Grafton, York, YO51 9QY), also known as JP Lockhart LLP provides ‘Recruitment Services’ in its capacity as an Employment Agency.

JP Lockhart LLP takes the security of your information seriously and pursuant to our obligations under applicable data protection laws regarding the lawful processing of Personal Information to support the provision of our ‘Recruitment Services’, JP Lockhart LLP wishes to inform you about the manner in which we collect, use, disclose, retain and transfer Personal Information about you (as defined below) to enable us to provide these services to you.

JP Lockhart LLP’s privacy policy will be reviewed from time to time to take account of new laws and technology, changes to our operations and practices and to make sure it remains appropriate to the changing environment. Any information we hold will be governed by the most current version of the privacy policy.

In order to provide ‘Recruitment Services’ we will require your Personal Information.

1). Reasons for collecting personal information

We collect your personal information so that we can provide our services to you, including to:

  • Provide you with information about job vacancies;
  • Assist you in finding a suitable position where required;
  • Maintain our business relationship, where you are a client or candidate or prospective candidate;
  • Provide you with recruitment services - which may include career guidance and management;
  • Inform you of events, services and possible job opportunities;
  • Assist in managing our relationship with you and our clients and perform administration or operational functions.

2). How your personal information is collected

Personal information may be obtained via a number of sources:

  • Our website
  • When you submit your curriculum vitae ‘CV’ to one of our Partners;
  • When you connect with them via a professional networking site;
  • When you discuss a recruitment opportunity with them;
  • From freely available information within the public domain.

It is not compulsory to provide us every item of information we ask for but the more information you volunteer, the better we can tailor our services to your needs. If the personal information we have requested is not collected, we may not be able to provide recruitment services to you.

3). Personal Information:

By “Personal Information” we mean your:

  • Name, address, telephone number, e-mail address, CV information (e.g., employment history, education, job qualifications, professional credentials, memberships in professional organisations, skills, language skills, hobbies), salary, nationality, any photographs of you that are provided by you, information from former employers and other references.

In addition, any other information relating to you, to the extent you have provided us with such information in person, by telephone, email or via other methods (including professional networking sites), will be retained. We encourage you not to provide sensitive information to us. To the extent you elect to include sensitive information, we will retain that information.

4). Our use of Personal Information:

We will collect, use, disclose, retain and transfer Personal Information for purposes such as:

  • To assist you with the identification, evaluation and/or selection of a role with a prospective employer;
  • To disclose or transfer your personal information to prospective employers where you are interested in an available position or where you have otherwise agreed we may disclose it;
  • To check or confirm references;
  • To verify the accuracy of Personal Information and conduct appropriate background checks;

5). Direct Marketing

We will collect, use, disclose, retain and Transfer your Personal Information

  • To direct-market our services, advise you of news, industry updates and job vacancies. Where we do so, you will be able to unsubscribe from such communications by notifying JP Lockhart LLP.

6). Third Parties

In the provision of recruitment services, we use third parties to perform certain functions on our behalf and may pass on your Personal Information:

  • To trusted third parties where we have retained them to provide services that you or our clients have requested, such as reference, qualification and criminal reference checking services (as required), verification of the details you have provided from third party sources, psychometric evaluations or skills sets;
  • To third parties who perform functions on our behalf and who also provide services to us, such as professional advisors or IT Consultants carrying out testing and support on our business technology systems.

If JP Lockhart LLP merges with or is acquired by another business or company, we may share personal information with the new owners of the business or company and their advisors and if this happens, you will be sent notice of such event. We may also release personal information to regulatory or law enforcement agencies, if they require us to do so. We will also disclose your information where we are permitted and requested to do so by law.

We will not use Personal Information for any other purpose incompatible with the purposes outlined in this document, unless it is required or authorised by applicable law, authorised by you, or is in your own vital interest (e.g., in the case of a medical emergency).

7). Retention period:

All Personal Information will be stored for a period of 1 year following the last action we took in relation to assisting you with securing a new position. At the end of this period, we will review and retain minimal personal information to comply with any applicable reporting requirements, e.g. for tax purposes and all other personal information and correspondence will be deleted from our electronic systems and hard copies securely shredded.

8). Transfer of Personal Information:

In the provision of our recruitment services, it may be necessary to transfer Personal Information to clients or prospective clients throughout the world, including countries outside of your country of residence and the European Economic Area (EEA) which may not provide the same level of data protection as in the country where you reside. We will notify you in the event we wish to transfer your data in order to explore job opportunities for you outside the European Economic Area (EEA) and we will give you the opportunity to withhold your consent to such transfer.

9). Internet-based Transfers:

Given that the Internet is a global environment, using the Internet to collect and process personal data may involve the transmission of data on an international basis. Unfortunately transmitting personal information over the Internet cannot be guaranteed to be 100% secure. Therefore, by communicating electronically with us, you acknowledge and agree to our processing of personal data in this way.

10). Protecting Personal Information:

JP Lockhart LLP takes technical, organisational, and administrative measures to protect against the loss, misuse and alteration of the Personal Information we hold. While we have security measures in place to protect against the loss, misuse and alteration of personal information under our control we cannot guarantee that loss, misuse or alteration of personal information will not occur.

11). Data Integrity:

JP Lockhart LLP takes reasonable steps to ensure that the Personal Information we process is reliable for its intended use, accurate and complete as necessary to carry out the purposes described in this document. Your co-operation in helping us to keep your personal information accurate by informing us of any change to your Personal Information namely but not limited to your name, address, contact details is an important part of this. If you would like to review or change the details you have supplied us with, you may do so at any time by notifying us in writing.

12). Privacy Policy Updates:

JP Lockhart LLP reviews its privacy policy and makes amendments where necessary to comply with relevant guidelines. We ask that you to periodically review this page to ensure continuing familiarity with the most current version of this Policy. Any information we hold will be governed by the most current version of the privacy policy.

13). Website Cookies:

JP Lockhart LLP does not use Cookies on our website.

By engaging with JP Lockhart LLP, you give Consent to the collection, use, disclosure, retention, and transfer of Personal Information as set forth herein.

14). Your rights:

  • You always have the right to access and request the Personal Information that we have retained and stored.
  • That we provide that information in a structured, commonly used, machine-readable and interoperable format.
  • That we rectify any erroneous or inaccurate Personal Information related to you.
  • The right to decline direct marketing and automated decision making.
  • The right not to be profiled by your data.
  • The right to object to our continued processing of Personal Information.
  • The right to revoke the Consent or request complete deletion of Personal Information from our systems by providing us with an appropriate written request.

In line with our retention period, whilst we minimise your Personal Information held after 1 year, should you request the complete deletion of your file, please be aware that we may not be able to do so where your file holds information about our clients or financial information that we need to keep to comply with legal requirements e.g. for tax purposes. Where we are unable to comply with your request, we will provide reasons for failing to do so.

15). How to make a complaint

If you believe that we have breached this policy, or any other applicable privacy or data protection laws or regulations which may apply to JP Lockhart LLP, then you should make a complaint to JP Lockhart LLP in the first instance. You should address your complaint in writing to the individual listed below, and you should include as much detail as you can about the personal information affected, and the circumstances that you believe amount to a breach of this policy or the applicable privacy or data protection law or regulation.

We will undertake an internal investigation, and we may contact you if we need to obtain any further information in relation to your complaint. Our response will be provided within 1 month and will set out the results of our investigation, including whether we agree that JP Lockhart LLP has breached this privacy policy or applicable privacy or data protection laws or regulations.
